How can a compass with 12" legs measure 30" between the points like in the picture?

It only needs to have 15" between points to make a 30" circle. 12" legs achieve that less than 90° open.

Will this accommodate a paint marker, larger than a pencil?

The holder for the pencil is about the size of a standard pencil, so I would say no. I suppose you could tape the marker to it, but it won't fit in the holder.

How do you get it to open. I received mine in the mail today and I can’t get it to spread apart

All you have to do is to simply spread it apart as needed. You may have to use a little pressure. One thing that could cause trouble is the little black locking nut on the top. Make sure it is loose first Just turn it counter-clockwise to loosen it. To fit a regular number 2 pencil in the holder, you may have to sand it down a little.

Great Compass , but we’re missing the two set screws 😥

The carpenter's 12" compass I received lacked the locking and pencil retention screws necessary for its use. I e-mailed the Mr. Pen folks to request the screws early that evening. They responded via e-mail around three the next morning apologizing for the problem and stating that if I'd send them my Amazon order number they would be happy to send me a new compass. I did so and received notification that my order had shipped that same day. Two days later I received my new compass. No hassle and prompt, cheerful customer service make this a great outfit to do business with. And yes, the product was of great quality.
